Attorney General Eric Schmitt Files Lawsuit Against Missouri School Boards Association

Missouri Attorney General Eric Schmitt has filed a lawsuit against the Missouri School Boards Association.

The suit alleges the MSBA violated the state’s Sunshine Law.

JEFFERSON CITY, Mo. – Today, to kick off Sunshine Week, Missouri Attorney General Eric Schmitt filed suit against the Missouri School Boards Association for alleged violations of the Sunshine Law.

The Missouri Attorney General’s Office previously requested records from the Missouri School Boards Association (MSBA) related to their role in the October 4, 2021 memo from the Biden Administration and National School Boards Association that designated concerned parents who show up to school board meetings as “domestic terrorists” and called for FBI surveillance of those parents. The Office also requested documents related to MSBA guidance on critical race theory, mask mandates, and IEP meeting policies. The MSBA failed to respond to Sunshine Law requests from the Missouri Attorney General’s Office.

“Today, I filed a lawsuit against the Missouri School Boards Association for hiding public records – records that the public and particularly parents of children in Missouri’s schools have a right to see. For months, my Office has been fighting to get to the bottom of MSBA’s role in the letter to the Biden Administration that led to the federal government investigating concerned parents,” said Attorney General Schmitt. “Further, we’ve sought records related to IEP recording policies, Critical Race Theory, and MSBA’s guidance to school districts on mask mandates. At every turn, we’ve been stonewalled. On behalf of parents across the state, I’m filing this lawsuit to obtain public records about important issues that affect their children and children in Missouri schools across the state.”

The Attorney General’s Office argues that the MSBA is subject to the Sunshine Law because: MSBA is a quasi-public governmental body under the Sunshine Law, MSBA’s corporate structure satisfies the definition of a quasi-public governmental body, MSBA’s primary purpose satisfies the definition of a quasi-public governmental body, MSBA performs a public function and thus satisfies the definition of quasi-public governmental body, MSBA’s funding comes almost entirely from public funds, MSBA provides training required by Missouri law, and Missouri law empowers MSBA with important public functions.

In October 2021, the Missouri Attorney General’s Office submitted a Sunshine Law request to the MSBA to get public information to understand MSBA’s role in the October 4, 2021 memo from the National School Boards Association that called on the federal government to investigate parents as “domestic terrorists.” The lawsuit states, “Upon information and belief, MSBA was aware weeks in advance of the NSBA’s plans to send a letter to President Biden. Upon information and belief, MSBA initially agreed with NSBA’s letter. MSBA retweeted NSBA’s announcement that it asked the Biden Administration for ‘federal assistance.’”

The Attorney General’s Office also sought records related to MSBA’s guidance to schools on mask mandates, as well as the MSBA’s involvement in Critical Race Theory. According to the lawsuit, MSBA was listed as a client of “Educational Equity Consultants,” who provides “anti-racism” resources for schools such as publications from Ibram X. Kendi and the 1619 Project. On mask mandate guidance, the lawsuit states, “Upon information and belief, in the August 13, 2021 bulletin, MSBA labeled any parent or leader seeking to apply the new law [HB271] to school district mask mandates as ‘anti-public school forces looking for headlines.’”

In response to the Attorney General’s Office’s initial Sunshine Request relating to MSBA’s involvement with the National School Boards Association’s letter to the Biden Administration, counsel for MSBA stated that there were no responsive records, however, as the lawsuit alleges, there are very clearly responsive records for that request.

The lawsuit states that MSBA failed to respond to at least two Sunshine Law requests from the Attorney General’s Office as required by the Sunshine Law. The Attorney General’s Office also received a Sunshine Law complaint from a citizen alleging that MSBA had similarly not responded to their Sunshine Law request.

Lastly, the Attorney General’s Office alleges in the lawsuit that MSBA has failed to identify its custodian of records, a violation of the Sunshine Law.

The lawsuit is asking for the Boone County Circuit Court to enter a judgment requiring MSBA to comply with the Sunshine Law.

Joplin Police Officer Laid To Rest

Joplin residents lined Main Street to pay their respects to a fallen police officer.

Corporal Ben Cooper was shot in the line of duty by a suspect.

The funeral was held on the Missouri Southern State University campus.

It was followed by flyover and three volley salute, then a procession through the streets of Joplin.

Corpora; Cooper joined the Joplin Police Force in 2003.

Springfield Police Looking For Fugitive

Springfield Police are asking for residents to be on the lookout for a fugitive.

Officers say 56-year-old Ronald James Brooks is wanted on a felony warrant in Greene County for delivering a controlled substance.

He is six foot two, 187 pounds, with black hair and brown eyes.

He also has tattoos reading “Inglewood” and “Jennifer My Heart For Life.”

Man Charged with Assaulting Greene County Deputy Pleads Guilty

A Bolivar man has entered a guilty plea after leading law enforcement on a high speed car chase that ended with a crash.

Seth Hay was charged with two counts of first-degree assault, second-degree kidnapping, resisting arrest and first-degree assault of a special victim. Police were called to a report of a disturbance regarding Hay, at which time he stole the callers vehicle in search of drugs.

Hay picked up an individual to attempt to secure methamphetamine. Officers attempted to pull Hay over, which began a high-speed chase with authorities exceeding 100 miles per hour.

At the conclusion of the chase, Hay purposefully drove his vehicle into the patrol car of a Greene County Deputy at a high speed. The officer was outside of the vehicle and was thrown over 50 feet from the scene of the crash.

After his arrest, Hay told investigators that he crashed into the deputies car on purpose, as he felt he had lost everything and wanted to kill himself.

Missouri’s Lieutenant Governor Orders Flags to be Flown at Half Staff for Joplin Police Corporal Benjamin Cooper

Missouri Lieutenant Governor Mike Kehoe, who’s acting as governor while Governor Mike Parson is on a European trade mission, is ordering all U.S. and Missouri flags to be flown at half staff through sunset Tuesday evening.

The order applies to all government buildings in Jasper and Newton Counties, and it’s in honor of Joplin Police Corporal Benjamin Lee Cooper.

Cooper and Officer Jake Reed were shot last Tuesday while trying to arrest a man outside of a local shopping center.

Cooper died shortly after being rushed to a local hospital, while Reed died several days later.

Kehoe says “Corporal Cooper’s senseless killing is a reminder of the dangers law enforcement officers willingly face each day to keep us safe, and of the debt we owe them for their courageous service.

Cooper’s public funeral is taking place at 1:00 p.m. Tuesday at the Leggett and Platt Center on the campus of Missouri Southern State University.

A similar order is expected on Friday, when Officer Reed’s funeral takes place at 1:00 p.m. at the Leggett and Platt Center.

Suspects Pull Gun On Playstation Seller

A man trying to sell a Playstation on Facebook Marketplace almost got it stolen from him at gunpoint.

Springfield Police say the man met the two suspects on a Walmart parking lot after they expressed interest in buying the console.

They pulled a gun and tried to take the Playstation away from him.

They started to drive away but the man was stuck in the window trying to retrieve his Playstation.

He managed to get it back and the suspects got away.

Springfield Police have not yet apprehended the suspects.

Man Charged in Connection with Shooting in Springfield

A man with an extensive criminal history in another state has been charged after a shooting incident that occurred earlier this month.

The shooting took place on March 8, when 37-year-old Walter Weatherspoon shot at a man on South Westwood Avenue.

According to reports, Weatherspoon and the victim in the case got into an altercation, at which point both people pulled out a gun. The victim’s sister tried to step in front of them to stop it, at which point Weatherspoon fired a shot.

No details have been released as to whether or not the victim or his sister were shot. Weatherspoon has been charged with first-degree assault and armed criminal action in the case.

Weatherspoon has already been convicted of numerous charges in Wisconsin.

Incident in Carthage Leads to Lockdown at Nearby Schools

Police say a suspect with a weapon evaded police near two schools in Carthage. The incident occurred near both Steadley Elementary and Carthage Intermediate Center.

Both schools are part of the Carthage School District.

The incident happened at around 1 p.m., when police attempted to apprehend the suspect, who had a weapon. The suspect began evading police and heading in the direction of the two schools.

The suspect was arrested, and no injuries were reported. The lockdown was lifted shortly after the suspects arrest.
